and the services we provide, including website design, development, and related digital services. By accessing our website or engaging our services, you agree to these Terms. If you do not agree, you should not use our site or services.

1. Eligibility

You must be at least 18 years old to use our services. By engaging with Weboq, you confirm you are legally able to enter into a binding agreement.

2. Services Provided

Weboq provides a broad range of digital and creative services, which may include but are not limited to:

  • Website Design & Development – Custom websites, applications, integrations, UX/UI solutions, WordPress builds, and performance optimization.
  • Digital Marketing & Strategy – Search Engine Optimization (SEO), paid advertising campaigns, analytics consulting, AI-driven strategies, conversion optimization, and related digital advisory services.
  • Content, Tutorials & Tools – Publication of web design opinions, style commentary, tutorials, educational resources, code samples, templates, and free or paid web tools intended for learning, demonstration, or reference purposes.
  • Creative & Visual Services – Graphic design, photography, branding, and logo design, as well as associated digital media and creative direction services.
  • Consulting & Broader Digital Services – Technology consulting, AI integrations, marketing strategy, and other digital services relevant to the domain of design, development, and online business presence.

Service availability, timelines, and deliverables will be outlined in a written proposal, quote, or agreement specific to your project.

3. Client Responsibilities

Clients agree to:

  • Provide accurate and timely information needed for project completion.
  • Supply content (e.g., text, images, branding) unless otherwise agreed.
  • Ensure they have rights to any materials provided.
  • Respond to feedback requests in a timely manner.
  • Maintain any hosting, domain, or third-party subscriptions not explicitly (or always or necessarily) managed by Weboq.

4. Intellectual Property Rights

  • All preliminary designs, drafts, and proposals remain property of Weboq until full payment is received.
  • Upon full payment, the final website deliverables become the client’s property, unless otherwise specified (e.g., licensing of third-party tools, plugins, or templates).
  • Weboq retains the right to display completed projects in our portfolio and marketing materials, unless otherwise agreed in writing.

5. Payment & Billing

  • Payment terms will be outlined in your project proposal or invoice.
  • A deposit may be required before work begins, with balance due upon delivery or milestone completion.
  • All fees are non-refundable unless otherwise specified.
  • Late payments may result in suspension of work and additional fees.

6. Revisions & Scope of Work

  • Proposals include a specified number of revisions. Additional revisions or changes outside of scope may incur extra charges.
  • Scope changes will require a new proposal or addendum.

7. Third-Party Services & Tools

Weboq may recommend or integrate third-party services (e.g., WordPress plugins, themes, hosting providers, analytics tools).

  • We are not responsible for third-party service performance, availability, or licensing costs.
  • Clients are responsible for maintaining third-party accounts and subscriptions.
  • Links to third-party sites are provided for convenience only; access is at your own risk.

8. Warranties & Limitations

We warrant that deliverables will function as described at the time of delivery, provided they are used on compatible systems and hosting environments. We are not responsible for issues caused by third-party updates, hosting failures, security breaches, or modifications made by others after delivery.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Weboq shall not be liable for indirect, incidental, or consequential damages (loss of revenue, profits, data, or goodwill).
  • Our total liability for any claim shall not exceed the fees paid by the client for the specific project.

10. Indemnification

Clients agree to indemnify and hold Weboq harmless from any claims, damages, or expenses arising from:

  • Content provided by the client (e.g., copyright or trademark violations).
  • Misuse of deliverables.
  • Failure to comply with applicable laws (e.g., data privacy, accessibility).

11. Confidentiality

Both parties agree to maintain the confidentiality of proprietary or sensitive information exchanged during a project, unless disclosure is required by law.

12. Termination

Either party may terminate the agreement with written notice if the other party materially breaches the Terms.

  • Work completed up to termination will be invoiced and must be paid.
  • Deposits are non-refundable.
  • Upon termination, you must stop using any non-paid deliverables and destroy any copies of Weboq materials.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the state or federal courts located in Orange County, California.

14. Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with an updated “Last Updated” date. Continued use of our site or services after updates indicates acceptance.

15. Editorial Content, Opinions, and No Professional Advice

From time to time, Weboq may publish opinions, reviews, or commentary on websites, layouts, styles, UX patterns, accessibility approaches, SEO concepts, performance tactics, or other web-related topics. We may also release free tools, demos, calculators, checklists, or code snippets (“Web Tools”).

  • Informational Only. All editorial content and Web Tools are provided for general informational and educational purposes and reflect our opinions at the time of writing. They are not professional, legal, financial, or compliance advice, and they do not guarantee any outcome (e.g., rankings, conversions, performance).
  • Use at Your Own Risk. You are responsible for evaluating fitness for your use case, testing for compatibility, performance, accessibility, security, and regulatory compliance.
  • No Client-Agency Relationship by Content Use. Accessing or using editorial content or Web Tools does not create a client relationship with Weboq. Engagement requires a signed proposal or written agreement.
  • Open-Source/Third-Party Code. Where we reference or include third-party or open-source components, such components are subject to their respective licenses. You must review and comply with those licenses.

16. Restrictions on Use of Materials; Logos, Trademarks & Third-Party Images

16.1 Restrictions on Use of Materials

This site and all materials on it (including text, graphics, designs, screenshots, code examples, and documentation) are owned or licensed by Weboq and protected by intellectual property laws. Except as expressly permitted by these Terms or by written permission from Weboq:

  • You may not copy, reproduce, republish, upload, post, transmit, scrape, mirror, or distribute any materials in whole or in part, in any medium, for commercial purposes.
  • You may download one copy of publicly available materials to a single computer for personal, non-commercial use only, provided you retain all copyright and proprietary notices and do not modify the materials.
  • Use of any materials on any other website, app, or networked computer environment for any purpose is prohibited unless expressly authorized by Weboq.
  • All trademarks, service marks, trade names, and branding are proprietary to their respective owners.

16.2 Logos and Images Disclaimer (Fair Use / Demonstration)

Third-Party Marks. Brand names, logos, and trademarks shown on the site may be used under nominative fair use for identification, editorial review, commentary, or demonstration purposes.
